Social Security Disability Attorneys
Our disability lawyers help mentally and physically disabled individuals that can no longer work to obtain the Social Security benefits that they are entitled to. If you are disabled and unable to work, then you may be entitled to Social Security Disability (SSD) or Supplemental Security Income (SSI) benefits. Our Alabama disability lawyers know the Social Security disability laws and can file your initial claim or file your appeal if you are initially denied your claim for benefits.
Either way, our disability lawyers in Alabama can handle your application and appeal for Social Security benefits and get the benefits you deserve. We understand that the application and appeals process can seem overwhelming, but our social security attorneys will attempt to make the process as simple as possible and navigate your claim through the application process.
A part of every employee’s paycheck goes towards Social Security Disability Insurance, which means that if you ever become disabled (and have paid into the insurance program) then you will be awarded SSDI payments. It works in a similar way to private disability insurance programs, in that you pay into it and if you become disabled, you can receive benefits. Even though you pay into the program, it does not mean that you will be awarded benefits when you apply initially. About 65% of all initial applicants are denied, but about 66% of all of those denied initially that file an appeal are awarded benefits at an administrative hearing.
You do not have to pay anything to our disability lawyers when we file your initial application, reconsideration, or your appeal. We are only paid if you are awarded any benefits through something called a contingency fee. When you get awarded benefits, you receive a lump sum of back pay benefits (all of the monthly payments you should have received from the date you were disabled to the date you were awarded benefits).
We only receive a percentage of this lump sum back pay benefits and that is all. Our attorneys do not receive any of your monthly benefits after you are awarded them. In addition, you do not pay anything to us except for a percentage of these back pay benefits, if awarded them.
The process for applying for Social Security Disability Insurance benefits is to make an initial application for benefits, and if denied to file a reconsideration request. If this reconsideration request is denied (which the vast majority are), then we file your appeal and have a hearing in front of an Administrative Law Judge.
This hearing can take a long time to have, sometimes taking a year or longer to get due to the backlog of pending appeals. In preparation for this hearing, our disability attorneys will prepare statements from your physician and other individuals that can testify as to your condition and other evidence to present at the hearing.
At this hearing, our disability attorneys will present this evidence and the Judge will make a decision based on the evidence provided. If you are awarded any back pay, then our lawyers will receive a percentage of this amount as payment for attorney fees, and if you are not awarded benefits, then our attorneys will be paid nothing and you will not owe us anything for the work we put into your case.
